2.2 Account Responsibility: You are responsible for maintaining the confidentiality of your account credentials and are fully responsible for all activities that occur under your account.

2.3 Account Security: You agree to immediately notify us of any unauthorized use, or suspected unauthorized use of your account or any other breach of security. We are not liable for any loss or damage arising from your failure to comply with the above requirements.

3. Subscription Terms

3.1 Subscription Plans: Users may select from different Subscription Plans available on our website. Each plan has specific features and pricing details.

3.2 Billing: Subscription Fees are billed monthly in advance and are non-refundable. Payments are collected via Stripe, and you authorize us to charge your payment method for the applicable fees.

3.3 Automatic Renewal: Unless you cancel your subscription, it will automatically renew at the end of each billing cycle at the then-current subscription rate.

3.4 Cancellation: You may cancel your subscription at any time through your account settings. Cancellations will take effect at the end of the current billing cycle.

4. User Responsibilities

4.1 Compliance: You agree to use our Services in compliance with all applicable laws, regulations, and policies.

4.2 Prohibited Activities: You agree not to:

  • Use the Services for any unlawful purpose;
  • Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Services or their related systems;
  • Violate or infringe the rights of others, including intellectual property rights.

5. Web Scraping

5.1 Data Collection: By creating a chatbot through our Services, you authorize Botflow to gather relevant data from your website through web scraping.

5.2 User Consent: You are responsible for ensuring that you have obtained necessary consent from your website users and that your use of web scraping complies with your website's privacy policies and terms.

6. Intellectual Property

6.1 Ownership: Botflow LLC retains all rights, title, and interest in and to the Services and all related intellectual property.

6.2 License: Botflow grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the Services in accordance with these Terms.

7. Limitation of Liability

These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law principles.

11. Dispute Resolution

Any disputes arising out of or relating to these Terms or the Services shall be resolved through binding arbitration in North Carolina, in accordance with the rules of the American Arbitration Association. Each party shall bear its own costs and fees associated with the arbitration.
